WEDDING TERMS AND CONDITIONS

  • The following constitutes the Videography Agreement (the “Agreement”) of Fay Films (the “Videographer”). Please read the Agreement in its entirety and contact the Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the signer of this Agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records.
  • It is understood that Fay Films is the exclusive Videographer retained by the client to cover outlined event. Any conflicts with other video coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.
  • Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for Fay Films each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client warrants that he/she has the legal rights to anything Fay Flms will capture, including photos, musical recordings, or any other materials delivered to Fay Films for inclusion in the clients video.
  • Due to music copyright laws, Fay Films can’t use your favourite song off Spotify if you plan to put the content on YouTube or other social media outlets, therefore Fay Films has a variety of songs in which are from subscription based website. All these songs are high quality and copyright free.
  • Fay Films is not responsible for poor audio if the groom does not agree to wear a lapel microphone, or the refusal of the client to allow camera-top lighting at the reception, or electrical or mechanical malfunctions on location that are beyond our control.
  • DVD’s & USBs are encoded in a standard format that will play on most common TV& DVD equipment. Fay Films cannot be held responsible for players that the DVDs or USB will not play on.
  • Fay Films will establish an arrival time for the wedding date with the client prior to that date and remain on duty until an agreed upon time with the client. Coverage hours included in the package are for the wedding date only and must be consecutive.
  • Fay Films reserves the right to use videos and photos for display and or promotional purposes. All video masters, raw footage and photographs remain the exclusive property of Fay Films. Any objection to this term must be made in writing/email when confirming the booking.
  • If for any reason the client needs to change the date of the wedding, every effort will be made to accommodate you. This is subject to availability & cannotbe guaranteed. Deposit will be non-refundable.
  • If Fay Films fails to comply with the terms of this agreement due to any event or beyond the control of Fay Films, including but not limited to illness, accident, labour disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Fay Films liability is limited only to a refund of all monies received.
  • The client reserves the right to terminate the contract for any reason up to 5 days after the date of deposit payment. Should the client terminate the contract, all money paid minus the retainer which is 10% of total cost will be refunded.
  • We aim to have your finished product back to you within 8 weeks. You will be contacted if this is set to be any longer. No financial penalty can be claimed against us for any delays past 8 weeks.
